Terms of Service

1. Acceptance of Terms

By creating an account or using Harkable (the "Service"), you agree to these Terms of Service. If you do not agree, do not use the Service. These Terms form a binding agreement between you and Spicy Rock Labs LLC ("we," "us," or "our"), a limited liability company organized under the laws of Iowa.

2. Service Description

Harkable is a text-to-audio conversion service available at harkable.app. You may upload documents and text, and the Service will generate audio files from that content. We reserve the right to modify, suspend, or discontinue the Service at any time with reasonable notice.

3. User Accounts and Responsibilities

You must provide accurate information when creating an account and keep your login credentials secure. You are responsible for all activity that occurs under your account. Notify us immediately at support@harkable.app if you suspect unauthorized access. You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Service.

4. Acceptable Use Policy

You agree not to use the Service to:

• Upload, process, or distribute content that infringes any copyright, trademark, or other intellectual property right
• Upload material you do not have the legal right to reproduce or distribute
• Upload illegal, defamatory, obscene, threatening, or otherwise prohibited content
• Circumvent, scrape, or abuse the Service in ways that harm other users or our infrastructure
• Resell or sublicense access to the Service without our written permission

Violation of this policy may result in immediate account termination.

5. User Content

You retain full ownership of any documents, text, or other content you upload ("User Content"). By uploading User Content, you grant Spicy Rock Labs LLC a limited, non-exclusive license to process that content solely for the purpose of delivering the Service to you. We do not claim ownership of your content. We are a processing conduit, not a publisher or editor of your content.

6. DMCA Safe Harbor

Spicy Rock Labs LLC respects intellectual property rights and complies with the Digital Millennium Copyright Act (DMCA). We do not proactively monitor User Content. If you believe content processed through our Service infringes your copyright, submit a takedown notice to support@harkable.app. Your notice must include: (a) identification of the copyrighted work; (b) identification of the infringing material and its location; (c) your contact information; (d) a statement of good-faith belief; (e) a statement of accuracy under penalty of perjury; and (f) your physical or electronic signature. We will respond to valid notices promptly and may terminate accounts of repeat infringers.

7. Credits

Credits purchased for use within Harkable are non-refundable, do not expire, and have no cash value. Credits may not be transferred, sold, or exchanged. We reserve the right to modify credit pricing with advance notice.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SPICY ROCK LABS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING UNDER THESE TERMS SHALL NOT EXCEED THE TOTAL AMOUNT YOU PAID US IN THE THREE (3) MONTHS PRECEDING THE CLAIM.

10. Termination

We may suspend or terminate your account at any time, with or without notice, if we reasonably believe you have violated these Terms or engaged in abusive behavior. Upon termination, your right to use the Service ceases immediately. Sections 5, 8, 9, and 11 survive termination.

11. Governing Law

These Terms are governed by the laws of the State of Iowa, without regard to conflict-of-law principles. Any disputes shall be resolved in the state or federal courts located in Iowa.

12. Changes to These Terms

We may update these Terms from time to time. We will post the updated version at harkable.app and update the effective date. Your continued use of the Service after changes are posted constitutes your acceptance of the updated Terms.
